American historians have generally accepted Richard Hofstadter's thesis that the scientism of Social Darwinism, or more appropriately, Spencerianism, dominated American thought in the late nineteenth and early twentieth century, and nowhere more enthusiastically or more purposively than within the conservative business community, which used Herbert Spencer's scientism to justify corporate business practices and to rewrite American Constitutional law to protect property interests against governmental regulations. Following Sharlin's general exposition of Herbert Spencer's scientism, this paper examines in detail the validity of (...) the Hofstadter thesis as applied to the notorious Lochner v. New York Supreme Court opinion of 1905. The conclusions drawn from this analysis are offered as a repudiation of the generally accepted belief that it was the conservative activists on the Court who were guilty of Spencerian scientism. On the contrary, the argument is presented that it was Justice Holmes and the liberal reformers who found the evolutionary doctrines of Spencer congenial to their efforts of identifying needed reinterpretations of the American Constitution with biological evolution. Emotion regulation is one of the major foci of study in the fields of emotion and emotional development. This article proposes that to properly study emotion regulation, one must consider not only an intrapersonal view of emotion, but a relational one as well. Defining properties of intrapersonal and relational approaches are spelled out, and implications drawn for how emotion regulation is conceptualized, how studies are designed, how findings are interpreted, and how generalizations are drawn. Most research to date has been (...) conducted from an intrapersonal perspective, and the shortcomings of this approach for understanding emotion regulation are highlighted. To date, emotion research has primarily focused on the experience and display of the emoter. However, of equal, if not more, importance is how such displays impact and guide the behavior of an observer. We incorporate a functionalist framework of emotion to examine the development of differential responding to discrete emotion, theorize on what may facilitate its development, and hypothesize the functions that may underlie such behavioral responses. Responsible innovation is gathering momentum as an academic and policy debate linking science and society. Advocates of RI in research policy argue that scientific research should be opened up at an early stage so that many actors and issues can steer innovation trajectories. If this is done, they suggest, new technologies will be more responsible in different ways, better aligned with what society wants, and mistakes of the past will be avoided. This paper analyses the dynamics of RI in policy (...) and practice and makes recommendations for future development. More specifically, we draw on the theory of ‘trading zones’ developed by Peter Galison and use it to analyse two related processes: the development and inclusion of RI in research policy at the UK’s Engineering and Physical Sciences Research Council ; the implementation of RI in relation to the Stratospheric Particle Injection for Climate Engineering project. Our analysis reveals an RI trading zone comprised of three quasi-autonomous traditions of the research domain – applied science, social science and research policy. It also shows how language and expertise are linking and coordinating these traditions in ways shaped by local conditions and the wider context of research. Building on such insights, we argue that a sensible goal for RI policy and practice at this stage is better local coordination of those involved and we suggest ways how this might be achieved. Attempts to explain emotion typically emphasize the interaction of evolutionary and socialization processes. However, in describing this interplay the role of the person is typically underemphasized or unaccounted for. This paper lays out empirical and theoretical rationale for considering the person as a major contributor to emotion generation and development.

In the emerging academic field of game studies, Roger Caillois’ Les Jeux et les hommes has already received the status of an obligatory reference. It is honoured as one of the few classic texts in game theory, but some also argue that it is not useful for analysing digital games. Caillois’ book is of particular interest for cultural theorists, though, because it presents a theory of games and play while also addressing the meaning of play. After analysing more closely why (...) Caillois’ theory falls short when it is applied to digital games, we suggest a slight modification of its categories. Starting from the four game dimensions outlined by Caillois - competition, chance, simulation and vertigo - and his two modes of playing, paidia and ludus, we build on his theory by distinguishing two additional game characteristics, called repens and repositio. Both deal with the internal, temporal organization of a game. Repens is a specific characteristic of games that appeals to the player’s desire to discover, explore and get to know the surprises a game has in store and to make progress by learning from these surprises. Repositio denotes complementary experiences: having to retry, return, replay and repeat a certain action while getting better at it with every try. The balance, or unbalance, between repens and repositio, as characteristic elements of many digital games, determines to a large extent their attraction. Finally, repens and repositio are not only indicators of fun in the playing of digital games; they also hint at basic elements in learning theories and social theory. The study of the interplay between repens and repositio can help in clarifying the possibilities and limitations of digital games for learning purposes. (shrink)

This study explores how financial executives retrospectively account for their crossing the line into financial statement fraud while acting within or reacting to a financialized corporate environment. We conduct our investigation through face-to-face interviews with 13 former C-suite financial executives who were involved in and indicted for major cases of accounting fraud. Five different themes of accounts emerged from the narratives, characterizing executives’ fraud immersion as a meaning-making process by which the particulars of the proximal social context and individual motivations (...) collectively molded executives’ vocabularies of fraud immersion. Our executives’ narratives portray their fraud entanglement as typically occurring in small, incremental steps. Their accounts expand our understanding of the influence of socialization on executive-level financial fraud beyond the individualized focus of the fraud triangle model. (shrink)

Background: Collaboration between physicians and nurses is key to improving patient care. We know very little about collaboration and interdisciplinary practice in African healthcare settings. Research question/aim: The purpose of this study was to explore the ethical challenges of interdisciplinary collaboration in clinical practice and education in Botswana Participants and research context: This qualitative descriptive study was conducted with 39 participants (20 physicians and 19 nurses) who participated in semi-structured interviews at public hospitals purposely selected to represent the three levels (...) of hospitals in Botswana (referral, district, and primary). Ethical considerations: Following Institutional Review Board Approval at the University of Pennsylvania and the Ministry of Health in Botswana, participants’ written informed consent was obtained. Findings: Respondents’ ages ranged from 23 to 60 years, and their duration of work experience ranged from 0.5 to 32 years. Major qualitative themes that emerged from the data centered on the nature of the work environment, values regarding nurse–doctor collaboration, the nature of such collaboration, resources available for supporting collaboration and the smooth flow of work, and participants’ views about how their work experiences could be improved. Discussion: Participants expressed concerns that their work environment compromised their ability to provide high-quality and safe care to their patients. The physician staffing structure was described as consisting of a few specialists at the top, a vacuum in the middle that should be occupied by senior doctors, and junior doctors at the bottom—and not a sufficient number of nursing staff. Conclusion: Collaboration between physicians and nurses is critical to optimizing patients’ health outcomes. This is true not only in the United States but also in developing countries, such as Botswana, where health care professionals reported that their ethical challenges arose from resource shortages, differing professional attitudes, and a stressful work environment. BackgroundThe increased risk of developing attention-deficit hyperactivity disorder (ADHD) in extremely preterm infants is well-documented. Better understanding of perinatal risk factors, particularly those that are modifiable, can inform prevention efforts.MethodsWe examined data from the Extremely Low Gestational Age Newborns (ELGAN) Study. Participants were screened for ADHD at age 10 with the Child Symptom Inventory-4 (N = 734) and assessed at age 15 with a structured diagnostic interview (MINI-KID) to evaluate for the diagnosis of ADHD (N = 575). We studied associations (...) of pre-pregnancy maternal body mass index (BMI), pregestational and/or gestational diabetes, maternal smoking during pregnancy (MSDP), and hypertensive disorders of pregnancy (HDP) with 10-year and 15-year ADHD outcomes. Relative risks were calculated using Poisson regression models with robust error variance, adjusted for maternal age, maternal educational status, use of food stamps, public insurance status, marital status at birth, and family history of ADHD. We defined ADHD as a positive screen on the CSI-4 at age 10 and/or meeting DSM-5 criteria at age 15 on the MINI-KID. We evaluated the robustness of the associations to broadening or restricting the definition of ADHD. We limited the analysis to individuals with IQ ≥ 70 to decrease confounding by cognitive functioning. We evaluated interactions between maternal BMI and diabetes status. We assessed for mediation of risk increase by alterations in inflammatory or neurotrophic protein levels in the first week of life.ResultsElevated maternal BMI and maternal diabetes were each associated with a 55–65% increase in risk of ADHD, with evidence of both additive and multiplicative interactions between the two exposures. MSDP and HDP were not associated with the risk of ADHD outcomes. There was some evidence for association of ADHD outcomes with high levels of inflammatory proteins or moderate levels of neurotrophic proteins, but there was no evidence that these mediated the risk associated with maternal BMI or diabetes.ConclusionContrary to previous population-based studies, MSDP and HDP did not predict ADHD outcomes in this extremely preterm cohort, but elevated maternal pre-pregnancy BMI, maternal diabetes, and perinatal inflammatory markers were associated with increased risk of ADHD at age 10 and/or 15, with positive interaction between pre-pregnancy BMI and maternal diabetes. Joseph Blado critiqued my probabilistic arguments against Roman papal doctrines by deploying probability arguments, particularly Bayesian arguments, in favor of the papacy. He contends that there are good C-inductive arguments for papal doctrine that, taken together, add up to a good P-inductive argument. I argue that his inductive arguments fail, and moreover that there are three good C-inductive arguments against papal doctrine in the neighborhood of his failed arguments. I conclude by critiquing his retreat to what he calls ‘skeptical (...) papalism’ as a last ditch sort of move to defend papal doctrine. (shrink)

Recently, there has been a resurgence of scholarly criticisms regarding the plausibility of the Roman Catholic doctrine of the Papacy. Broadly speaking, these problems include scholarly criticisms of the scriptural passages which Roman Catholic theologians claim support the papacy, historical discrepancies regarding apostolic succession from the Apostle Peter, and a priori intuitions about the moral nature of those who attain Papal Status. In this paper, I respond to these objections by utilizing Swinburne’s C-inductive strategy (Bayesian Confirmation Theory) – found in (...) his text, The Existence of God – and conclude that overall, there is a strong P-Inductive argument for the Papacy. There would appear to be enormous philosophical differences between some influential exponents in contemporary natural law ethics. It would appear that there are deep and irresolvable philosophical differences between Ralph McInerny, on the one side, and Germain Grisez, Joseph Boyle, and John Finnis, on the other, with regard to both the contents of the basic goods of natural law, and as to whether there is an objective hierarchy among the basic goods themselves. The second of these apparently unbridgeable philosophical (...) differences seems to account for the apparent differences between them on the starting point of morality. All of these putative philosophical differences seem to depend on what appear to be very different approaches by the two camps toward ultimate ends in ethics. I argue that the philosophical differences between the two camps on these fundamental matters are not considerable, and that whatever philosophical differences do exist lack philosophical support from either of the two sides. A geographically stratified cross-sectional survey was conducted in 2002 to investigate household-level factors associated with use of mosquito control measures and self-reported malaria in Malindi, Kenya. A total of 629 households were surveyed. Logistic regressions were used to analyse the data. Half of all households (51%) reported all occupants using an insecticide-treated bed net and at least one additional mosquito control measure such as insecticides or removal of standing water. Forty-nine per cent reported a history of malaria in the household. (...) Of the thirteen household factors analysed, low (OR=0·23, CI 0·11, 0·48) and medium (OR=0·50, CI 0·29, 0·86) education, mudcoral (OR=0·0·39, CI 0·24, 0·66) and mud block–plaster (OR=0·47, CI 0·25, 0·87) wall types, farming (OR=1·38, CI 1·01, 1·90) and travel to rural areas (OR=0·48, CI 0·26, 0·91) were significantly associated with the use of mosquito control, while controlling for other covariates in the model. History of reported malaria was not associated with the use of mosquito control (OR=1·22, CI 0·79, 1·88). Of the thirteen covariates analysed in the second model, only two household factors were associated with history of malaria: being located in the well-drained stratum (OR=0·49, CI 0·26, 0·96) and being bitten while in the house (OR=1·22, CI 0·19, 0·49). These results suggest that high socioeconomic status is associated with increased household-level mosquito control use, although household-level control may not be enough, as many people are exposed to biting mosquitoes while away from the house and in areas that are more likely to harbour mosquitoes. The anonymous fourth-century tract De poenitentia depicts with a grand oratorical flourish the universality of the psalms in the Christian world. Its author proclaims that the psalms are heard at vigils, at morning prayer, and at funerals in the city churches, but the power of “David” extends beyond their walls.

In this essay, I examine the relationality between life and water in the context of its intercorporeal manifestations. Drawing on key aspects of Merleau-Pontian phenomenology, my concern is to reflect on water’s enfleshment of life and its complex ecologies of intercorporeity. These Merleau-Pontian key aspects, I note, are in close dialogue with a number of Indigenous cosmo-epistemologies that envisage the world as constituted by profound ecologies of intercorporeal relationality. The loci of my analysis are the Sonoran Desert and the lands (...) of the Tohono O’odham people, all situated within the ongoing violent relations of power unleashed by the forces of settler colonialism, including the partitioning of Indigenous nations by the Mexico–US border, the ecological devastation left in the wake of the construction of the Trump border wall and the increasingly fraught situation of undocumented migrants attempting to cross the US border. The bodies of water that I discuss in this essay disclose the cycles of life and death that turn on the presence and absence of water. These cycles are increasingly ensnared in aquapolitical regimes of governmentality that, in settler colonial contexts, unleash lethal effects that kill both bodies of water and the entities that depend on them for life. Like most books in philosophy, Communicative Action and Rational Choice contains a large number of arguments. Each of these arguments I adhere to with a greater or lesser degree of conviction. Some of them I think are pretty decisive. In other cases, I was doing the philosophical equivalent of throwing things against the wall just to see what sticks. Of course, I did not present things that way in the book, choosing instead to dress up my scruffier arguments in (...) the hope that they might appear to share the same pedigree as my more refined ones. It is thus a testament to the astuteness of my critics here that they have focused their criticism almost entirely on my more tentative arguments—especially my so-called “pragmatic theory of convergence,” which is less a theory than a set of suggestions about how a theory might be constructed. Thus my desire to defend these arguments against criticism, which predominates in what follows, should be understood also as tempered by the recognition that much of what I say may ultimately prove to be unsustainable. The wall is defended by the idea that not only do experts possess knowledge beyond the ken of lay people, which is trivially true, but that there is an unbridgeable gulf between the two. The aim of this presentation, then, is to discuss the possibility of building a bridge between the ordinary educated citizen and the expert. The tool for this is the famous effort to disseminate scientific literacy, or more generally, any specific sophisticated (...) literacy. The subject-matter of this presentation, then, is scientific literacy, and the question is, how can it best be disseminated? Now the word "literacy" in expressions like "scientific literacy" and "computer literacy" may be meant literally or metaphorically. As I will try to show later on, if time permits, profound ambiguity and ambivalence reside here. The significance of all this remains to be seen. Let me first contrast any specific sophisticated literacy with elementary literacy, and center first on the elementary. It is of course the one that is denoted by the first two of the three r's, reading writing and arithmetic, the three skills teachers of the lower grades of elementary schools are supposed to transmit to their charges. Before discussing scientific literacy or computer literacy or any other specific sophisticated literacy, I will discuss this elementary literacy. My suggestion is that by advancing somewhat our knowledge of elementary literacy we can see what is specific to any specific literacy, however sophisticated it may be, but that there is more profit for understanding the nature of elementary literacy by examining specific cases. My thesis will be that any literacy, elementary or specific, is best achieved by guided, aided experimentation: the trainee should learn by trial and error.. (shrink)

This paper will investigate the anonymous collective of skilled artists which created an immersive work of art of a high order in the Abside (Apse) of the Grotte de Lascaux. The Apse is a roundish, semi-spherical, penumbra-like chamber (like those adjacent to romanesque basiliques) approximately 4.5 metres in diameter (about 5 yards) covered on every wall surface (including the ceiling) with thousands of entangled, overlapping, engraved drawings (Leroi-Gourhan, 1968, p. 315) for which, on request, I received a very unique (...) privilege of seeing, though far too briefly. The occurrence of oscillatory behaviours in living cells can be viewed as a visible consequence of stable, regulatory homeostatic cycles. Therefore, they may be used as experimental windows on the underlying physiological mechanisms. Recent studies show that growing pollen tubes are an excellent biological model for these purposes. They unite experimental simplicity with clear oscillatory patterns of both structural and temporal features, most being measurable during real‐time in live cells. There is evidence that these cellular oscillators involve an integrated input (...) of plasma membrane ion fluxes, and a cytosolic choreography of protons, calcium and, most likely, potassium and chloride. In turn, these can create positive feedback regulation loops that are able to generate and self‐sustain a number of spatial and temporal patterns. Other features, including cell wall assembly and rheology, turgor, and the cytoskeleton, play important roles and are targets or modulators of ion dynamics. Many of these features have similarities with other cell types, notably with apical‐growing cells. IntroductionEvery day, it seems, we advance into darkness we have not known before. It is not a journey we have sought out or chosen for ourselves. We are swept along by a current of malice that can only be avoided if we hide from the news. The spectacle of a mass anti-Zionist and antisemitic “Gaza Solidarity Encampment” on Columbia University’s central quad and elsewhere has structural predecessors, to be sure, like the Occupy Wall Street movement, but parallels with mass (...) antisemitism require comparison with earlier historical moments. As the University of Chicago’s president, Paul Alivisatos, wrote straightforwardly in a public letter, “the impact of an encampment depends on the degree to which it disrupts study, scholarship, and free movement around campus.”1 The Occupy Wall Street movement was notably accompanied by a substantial body of theoretical work, whereas the Columbia occupation is supported by little more than a Manichaean view of a world divided between oppressor and oppressed peoples. The chants are sounded without any plausible theory of how they could actually lead to the dissolution of the Jewish state. The students breaking windows and occupying a building at Columbia were certainly employing theory of a sort when they asserted that the university had a moral responsibility to deliver meals to them, but observers found the theory difficult to endorse. The students promise to remain until Columbia meets their divestment demands—which presumably means they will be in their tents for a very long time indeed, since for governing boards to cede their investment authority to mob action means giving up their other responsibilities as well. But Brown University’s governing corporation has agreed to meet with student representatives and hold a vote on divestment in the fall.2 I expect the results of the vote will disappoint the protestors. This article argues that the concept and practice of ‘self-organized learning’, as pioneered by Sugata Mitra (and his team) in the ‘Hole-in-the-Wall’ experiments (1999–2005) that inspired the novel Q & A (2006) and the resulting movie, Slumdog millionaire (2008) bear direct, but not uncritical comparison with Jacques Rancière’s account of ‘universal teaching’ discovered by maverick nineteenth century French pedagogue Joseph Jacotot. In both cases, it is argued, there is a deliberate dissociation of two functions of ‘teaching’ that are (...) often conflated: knowledge and mastery. Mitra’s development of computer-mediated learning among the supposedly ‘ignorant’ of India’s slums, and Rancière’s insistence on equality as a presupposition rather than a goal, both emphasize the agency of the student at the centre of learning, but in ways that displace both established pedagogical methods of ‘explication’ and the neoliberal ideology of ‘schooling’ as the harmonizing of individual and social functions of education. The crash of two 737 MAX passenger aircraft in late 2018 and early 2019, and subsequent grounding of the entire fleet of 737 MAX jets, turned a global spotlight on Boeing’s practices and culture. Explanations for the crashes include: design flaws within the MAX’s new flight control software system designed to prevent stalls; internal pressure to keep pace with Boeing’s chief competitor, Airbus; Boeing’s lack of transparency about the new software; and the lack of adequate monitoring of Boeing by the (...) FAA, especially during the certification of the MAX and following the first crash. While these and other factors have been the subject of numerous government reports and investigative journalism articles, little to date has been written on the ethical significance of the accidents, in particular the ethical responsibilities of the engineers at Boeing and the FAA involved in designing and certifying the MAX. Lessons learned from this case include the need to strengthen the voice of engineers within large organizations. There is also the need for greater involvement of professional engineering societies in ethics-related activities and for broader focus on moral courage in engineering ethics education. (shrink)

Kockelmans provides a clear and systematic treatment of the central themes and topics of Heidegger's later writings, focusing on the all-important question of the relationship of truth and Being. If we are to understand Heidegger's thought, Kockelmans explains, we must conceive it as a path or way, rather than as a finished system. Adopting this approach himself, Kockelmans leads us with scholarly care through the wide range of issues that Heidegger wrote about between roughly 1935 and 1965. (...) After a discussion of Heidegger's own effort to learn to think, subsequent chapters present Heidegger's views on such matters as the meaning of Being; the ontological difference; heaven and earth; gods and mortals; and language, art, science, technology, ethics, and politics. In these times of walls and razor-wires, open borders appear to be more utopian than always. Nonetheless, philosophers like Joseph Carens and, similarly but earlier, Timothy King and James L. Hudson, famously argued that the major philosophical perspectives in the Western world—libertarian, egalitarian, and utilitarian—would support a right to freedom of international movement of people. What would be the relative default position from the standpoint of natural law theory? In this article, I present a general introduction on natural law (...) theory and its role in and outside philosophy, before presenting claims specific to the migration debate. I then recall the defence of a right to free movement by two authors sympathetic to the natural-law tradition, Ann and Michael Dummett: a defence which is grounded in principles of fairness and reciprocity and develops elements belonging to international law. I also outline John Finnis’s more critical and nuanced position. Finnis is eager to legitimize state authority and the “special relations” binding fellow countrymen: however, I claim that the classic Thomist perspective in which he situates these claims ensure his respect of a right to international movement which could be characterized as a version of “open borders,” with some definitional restrictions and qualifications of this latter phrase. Finally, I deal with the theory of Alasdair MacIntyre. Trying to infer MacIntyre’s attitude toward migration from the classic but short article on patriotism, might turn out to be no less dif ficult than potentially misleading, especially if that article is not read in its details. Complementary elements are offered in MacIntyre’s account of natural law “as subversive.” On these grounds, I claim that, contrary to simplistic misreading of MacIntyre’s alleged “communitarianism,” MacIntyrean Aristotelian Thomism would endorse a theory of migration more compatible with reasonably conceived open borders. I conclude my chapter with a presentation of Aquinas’s concise intervention on the subject, and I show that it further supports my reading of the natural law tradition. (shrink)

In this paper I propose a model of demonstrative thought. I distinguish token-demonstratives, that pick out individuals, from type-demonstratives, that pick out kinds, or properties, and provide a similar treatment for both. I argue that it follows from my model of demonstrative thought, as well as from independent considerations, that demonstration, as a mental act, operates directly on mental representations, not external objects. That is, though the relation between a demonstrative and the object or property demonstrated is semantically direct, the (...) mechanism by which a demonstrative acquires its referent involves mediation by a perceptual representation. Finally, I argue that so-called 'demonstrative concepts'—which I treat as type-demonstratives—cannot perform the various philosophical functions that have been assigned to them. (shrink)

After the appearance of his influential Rudiments of English Grammar and A Course of Lectures on the Theory of Language and Universal Grammar, both of which are reissued in this series, Priestley produced in 1765 his Essay on a Course of Liberal Education, which is included and expanded on in this 1778 publication. Here he explains the reasons behind his decision to guide the (...) curriculum at Warrington Academy towards a greater focus on subjects with a more direct application to 'civil and active life'. He offers more general instruction on the cultivation of young men in various spheres, notably through foreign travel and developing 'knowledge of the world'. Priestley ends by outlining a suggested course of lectures on the history and laws of England. (shrink)

The main novelty my article brings concerns a particular iconographic motif: that known as the ‘trial by the water of reproach’. In the few cases where this is rendered, usually only Mary is presented as undergoing this test, but in Cappadocian art Joseph is also subjected to it. Additionally, to this visual topic, another one that is rarely depicted will be introduced and commented upon: that known as ‘Christ’s first bath’.
